Conditions of Use

Delivery

If you place a small order of $500 or less, or your order consists of strictly accessories, there may be an additional shipping charge. Shipping to some islands, congested cities, remote areas and other areas where access is difficult or freight carriers have limited coverage may also incur additional fees. If this is the case, one of our representatives will contact you after you place the order, or you can contact us to find out if any additional charges apply. You will receive a DELIVERY CHECKLIST via e-mail immediately following your purchase. This DELIVERY CHECKLIST outlines the procedure for properly inspecting an order when it is delivered or picked up. We will always replace any item that is missing or damaged providing it was noted on the paperwork you signed at the time you received the order. No claims will be allowed without such notes being made. You must save any damaged material and have it available for pick up. If you submit a claim for damaged material and do not have the damaged material for us to pick up, you will be billed for the replacement material and the freight to get it to you. If you refuse an order, you will be charged the actual original freight cost*, the return freight cost, and any restocking fees that might apply, which usually range from 20% to 40% of the order. Unless other arrangements have been made, you must be at the delivery address or have someone there to assist in unloading the order. The drivers will not unload the orders on their own. If you have someone other than yourself at the delivery address, that person must be able to inspect the order on your behalf.

General Freight Notes

Freight rates are valid for the contiguous 48 United States. There may be a surcharge for orders shipped outside the contiguous 48 United States, and certain remote areas within the U.S. All prices subject to change without notice. If an order is placed online, the freight rates are estimates. A flooring consultant may call you back to give you the actual freight rate. All additional freight costs must be approved by the purchaser before the order can be processed. Get Floors Online is not responsible for the amount of product ordered or typographical errors on the site. You should receive the stock status of your order within one to three business days. Once your order ships, depending on your location, the in route time is seven to ten days. Residential deliveries are "curbside". You must have someone at the delivery location to assist with off-loading of the order. Drivers do not carry material into your home.
 
Cancelled Orders
 
Due to the complexities of our order processing, all orders that are approved for cancellation will have a processing fee of $300.00 or 5% whichever is greater. There must be a written agreement for any canceled orders. By signing this, you agree to pay these fees for any canceled order after the credit card or check has been charged. 
 
Returns

Any returns must be pre-approved by our office via e-mail. Most returns are subject to restocking fees, and certain products have a no return policy (see special order and non-stock items in the next section). No returns are allowed whatsoever after 30 days of the order. If a return is approved, the customer would pay the actual original freight cost, the return freight cost, processing fees, and any restocking fees which usually range from 20% to 40% of the order. Also, the product being returned would need to be packaged properly according to the requirements of the freight carrier being used. If you return any merchandise that is not packaged properly, and there is damage as a result, you would be responsible for any loss incurred, and that loss amount would be deducted from any credit you might be due. There are no returns on flooring accessories (moldings, underlayment, glue, etc.), special order products, or ceramic/porcelain tile. All returns must be arranged for and made via our freight carriers unless otherwise approved. No returns are allowed on opened boxes or installed material. 

Special Order or Non-stock Items

Due to the unique nature of the items we sell, in addition to the complexity and expense involved in shipping them, some items are considered special order or non-stock items. Special order or non-stock refers to any item that is not stocked by the vendor or manufacturer we purchase from in order to fulfill your order or any item that has a no return policy by those same vendors or manufacturers. If you're purchasing any items that are considered special order or non-stock, it will be clearly indicated on your invoice. No cancellations, returns, refunds or delivery refusals are allowed on any orders containing these special order or non-stock items.

Natural Stone Disclaimer

Natural stones are a product of nature. Any variations in texture, color, veining, and pattern must be accepted. These differences and disparities are part of what makes the stone beautiful, and should not and are not considered flaws. Purchasing Natural Stone implies that you acknowledge that natural stones vary in pattern, texture, and color. The actual stone delivered may differ from the sample or picture(s) shown on getfloorsonline.com. There are no returns, refunds, or exchanges on Natural Stone.

By purchasing any of our natural stone products, you accept our natural stone disclaimer. If you are not in agreeance with our natural stone disclaimer, do not purchase Natural Stone. No claims can be filed due to color variation, texture, veining, or pattern.


Claims (Defective Product & Warranty)

Unless otherwise stated, all products are first-quality material. Any claim for visually defective or damaged material must be filed prior to installation. You or your installer must inspect all material before installation. If there are any defects outside industry tolerances, you must NOT install that material and immediately file a claim for the defective product. Any material installed with visual defects will not be eligible for credit or replacement. Any claims submitted for a defective product or a product warranty issue must be done online. You simply log into your account, click on the my orders tab, click details, and then click on the "File Claim" button. If you file a claim, you would have to pre-pay the claim inspection fee which usually costs $500.00 or more and we would arrange an inspection by a certified inspector in your area. If the claim is valid, you would be refunded the inspection fee and the claim would be resolved according to the manufacturer's guidelines. If the claim is turned down, you would not be refunded whatsoever and no credits or exchanges would be allowed.

Legal
 
This Exclusion of Liability Agreement ("Agreement") is entered into between Catalfamo Flooring and its subsidiaries, collectively referred to as "the Company," and the consumer, installer, contractor, architect, and final purchaser ("You"). By proceeding with the purchase of our products, You acknowledge and agree to the terms outlined in this Agreement.
 
Catalfamo Flooring and its subsidiaries expressly disclaim any liability for products purchased by consumers that are improperly used or installed. This exclusion extends to areas where the purchased material cannot be used, encompassing both residential and commercial spaces, including but not limited to restaurants, bars, hospitals, post offices, government facilities, and all other indoor and outdoor areas.
 
By continuing with the purchase, You explicitly agree that no legal action can be taken against Catalfamo Flooring and its subsidiaries for any accidental lawsuits arising from the use or installation of our products. This comprehensive exclusion is designed to protect the Company from litigation related to product misuse, installation errors, or other unforeseen circumstances.
 
As the consumer, installer, contractor, architect, and final purchaser, You acknowledge and accept that it is your sole responsibility to conduct thorough research on the invoiced material before making a purchase. This includes but is not limited to, gathering all specification data necessary for optimal performance in specific areas.

By this purchase, you agree to all of the purchase Terms & Conditions and understand that there are no returns allowed after 30 days, and returns must have prior authorization. No returns will be allowed without a Return Authorization issued from our office. There are no returns on accessories, ceramic/porcelain tile, or special order products. You will be responsible for the actual original freight charges, return freight charges, and any restocking fees (usually 35%) if the order is refused. If you place an order agreeing to the terms and conditions, the purchase/invoice is considered a binding contract. If any lawsuit or other legal dispute were to arise, both parties agree the proper venue for the legal proceedings will be Broward County, Florida, United States of America. All "price match" orders placed are subject to management approval and shall constitute a sale unless otherwise advised.
 
This Agreement serves as a legal shield for Catalfamo Flooring and its subsidiaries, safeguarding the Company from potential litigation related to product performance and installation issues. It establishes clear boundaries on liability and places the onus on the purchaser to exercise due diligence.
 
By finalizing the purchase transaction, You explicitly affirm that You do not hold Catalfamo Flooring and its subsidiaries liable for any consequences arising from improper use or installation of the purchased materials. This Agreement is a legally binding acknowledgment of your assumption of responsibility for due diligence and compliance with all relevant technical and legal requirements.
 
By proceeding with the purchase, You acknowledge the importance of conducting thorough research, assuming responsibility for product use and installation, and absolving Catalfamo Flooring and its subsidiaries of any liability.

Upon making this purchase, you agree to Catalfamo Flooring's utilization of a debt collection agency for any outstanding debts. This encompasses, but is not restricted to, unresolved credit card disputes, unpaid orders, duplicated freight claim collections, and more. All debt collection endeavors will be carried out in adherence to relevant federal and state debt collection regulations, including the Fair Debt Collection Practices Act (FDCPA) in the United States. In the event of any unpaid debts on your part, you will assume responsibility for both the debt and any accompanying fees related to hiring the debt collection agency. Should the debt remain unsettled, you will also bear the burden of additional collection fees, accrued interest, or potential legal actions. Your personal information will solely be disclosed to the debt collection agency for the sole purpose of debt recovery and will be handled in accordance with the pertinent data protection legislations. If you believe the debt is in error, you are required to contact Catalfamo Flooring within 30 days to initiate a verification process for disputing the debt.

If any legal action, arbitration, or other proceeding located with the United States of America, is brought for the enforcement of this Agreement, or because of an alleged dispute, breach, or default in connection with any of the provisions of this Agreement, the prevailing party shall be entitled to recover reasonable attorneys'/collection agency fees and other costs incurred in that action or proceeding, including any appeal of such action or proceeding, in addition to any other relief to which that party may be entitled. 

General

All of the material we sell is subject to minor differences in shade, tone, dye lot, size, etc., and may vary from original samples. Images and product samples are representative of a product’s potential characteristics. There is no guarantee that the sample product or images will 100% match the product received. Get Floors Online is not responsible for any wrong images or misrepresented products on its site. All images are provided by the manufacturer. Get Floors Online suggests obtaining a sample before purchasing as images on a screen will look different than in person. It is the purchaser's responsibility to obtain a sample prior to purchasing as Get Floors Online will not be responsible or held liable for any color/shade discrepancies. Get Floors Online is responsible for sending the product that is listed on the purchaser's invoice. Unless otherwise stated, all products are first-quality material.

*The freight charge listed on your invoice may not be the actual freight cost. In some cases, a portion of the actual freight cost may be built into the unit cost of the material or we may be factoring in a manufacturer rebate in order to list a lower freight charge. There will be additional fees for shipping any orders outside the United States such as, but not limited to Canada. A representative will contact you after placing your order to discuss these additional fees.
